company changing hand -worried WP holder

Post by 9588 » Fri Jul 11, 2008 9:05 pm

Hi
I am a WP holder, my current employer is selling the company where i am working. my new employer has ensured me i will still be doing the same job. but he is intending to trade under a name.
will it effect my status? when the time comes to applying for my ILR, will i get rejected because of this?

No need to worry .....it doesn't have any effect on your future ILR application. You employer has to notify home offrice about your these changes......

You don't need to use the agent, just get the contact details from the BIA website and get your employers to write to the BIA with the new details.

Don't be spending money for something your employer can do, unless you want to give it away!!!

Hello 9588

It is free to do a technical cange of employment, and there is no need to apply for further leave to remain.

See the guidance

All it takes is a letter and a copy of your entry clearance or residence permit, along with evidence of the change of ownership. There is no need for the employer to use an agent, unless they have money to burn. Just make sure that they read the guidance before they write.

Hi Brothers
thanks
to simpify the matter, what i will need are:
1. letter from my new employer stating the change of trading name.
2. copy my resident permit
send them to the BIA
and job done?
that sounds really easy, will they ask for anymore else?

thanks again

Hello sisters

See the link to the guidance that I posted earlier. The employer may need to provide evidence. If it is a limited company, then sending evidence of the change of name from Companies House and change of ownership may be an idea. If it is not a limited company, does the employer have any other evidence of the change of ownership and change of name?

Your new employer should provide evidence to UKBA that he has bought the business that you work in. If this is an actual sale of a business "as a going concern" and not just a change of name then see the guidance for "Company Takeover" in PaperPusher's link.

In some kinds of takeover you also have a legal right to stay in the job on the same terms and conditions, so keep an eye on what the buyer tells you aout your job!
