Hi Everyone! My friend has very complicated case, i want you opinions. She is from Eu, living in uk since 2006, she was employed since that and got settled status in 2 working days after applying without any more extra evidence to prove her residence. She was married to Russian gay for 5years and 2months, this gay had a child from previous relationship, so this child was my friends stepdaughter, her husband and stepdaughter got EEA family permits because of her, after their divorce they still got another 5 year EEA family permits because of they previous relationship with her. My friend still had a good relationship with her stepdaughter after their divorce. Her ex-husband was arrested about 2 months ago and sentenced for 20months, so because her stepdaughter do not have no-one, my friend takes care of her while father is in custody. This child still have a family permit until 2021, she applied for her settlement shame on Monday, based on child's residency length(more then 6 years, even she is uk born), CoA received next day, but decision not yet. My question is if father has criminality do they will refuse child's application? My friend takes care of her while father is in custody. Because his realise day will be after December 2020, she decided to apply for child alone to get some status and continue attending school here. Do child have to pay for parents bad behaviour? Is actually means this if they will refuse because of fathers criminality.

I didn't understand everything.

Please try to jump some lines when you write. It makes your text easier to read.

If that girl is applying under her own right, I don't see why she will be "punished" because her father is a criminal. Nobody is immune to having a father in jail.

Still, the entire story seems full of oddities.

Yes you are right, text was quite long and without any space between lines,(I am posting by phone)but I tried to give an idea about whole story. Yes girl applied on her own residence(its more then 6 years). So because she applied her own rights and she is under the age will they refuse? Application is not linked to an adult. CoA is received already, which says they will receive decision shortly.

If she is applying on her own right, they are not going to penalize her because her father is in prison.

However, as she is under the majority age, they will certainly look around her to mum/dad.

Tnx for your response 🙏🏻 They know where dad is, but this girl doesn't have a biological mother, she past a way when girl was around age 1.
