MARRIAGE FOR NON EU OVERSTAYER

Hi everyone! I will keep this very short and miss some of the details but basically me and my boyfriend of almost 4 years have applied for EEA PR (for him) and EEA EFM (for me), we went this as a joint application. He is Romanian and I am from Russia. We were told by our lawyer that when we apply for EFM and get some sort of letter back from them (like certificate of application) we could give notice to get married. One question that i have is will i be able to marry my other half without an ID? My russian passport is at the home office but i have the COA and biometric letters from my EEA EFM application and my partner has an EU National Identify Card.

Has anyone ever been in this situation? Do you guys think we will be able to marry? I can provide everything else it’s just the ID that i don’t have since home office took it a long time ago. I’m also an overstayer as i don’t have any visas or documents.

No valid id, no marriage. No registrar would accept you with letters, bills or similar.

If you don't have a valid passport, you can see with your Embassy if they are not willing to help with a 1-year passport that allows you show a valid id to the Registrar. Some Embassy accept to help in these situations but I don't know for the Russian one.

As EU, your partner can demonstrate his own identity with an EEA ID or passport. But this doesn't demonstrate your own identity.

The Home Office will be informed that you are getting married.

Has your lawyer not advised that you can can only give notice to marry with a Home Office designated Registry Office? The Registrar is then legally bound to notify the HO who can then extend the notification period from 28 to 70 days in order to interview you both separately before the marriage can go ahead, should they choose to do so.

You mention that you have been in a relationship with your partner for 4 years. How long have you lived together, with the documented evidence to support the co-habitation.

Yes, we were aware of this. I was just under the impression that COA and some other letters from HO confirming that they have my passport will be enough to give notice since they have to tell them anyways but the registrar told me i’ll need a certified copy of it. I applied online, on Gov
for a certified copy of my passport and sent the documents they requested. It says it takes up to 30 days for them to respond. So i’m waiting

I lived with him at his family house at first for about 2 years and we officially moved in together November 2017 so almost two years soon.

I’ve provided letters from his parents confirming that i’ve lived there and that he payed rent for both me and him.

I came to UK with a student visa in 2014 but claimed asylum. My asylum case failed completely three years later and by this time i was in a relationship with my boyfriend. Then we applied for EFM in 2016, the lawyer recommended this application. But since we haven’t had 2 years of living together and not a lot of evidence it was rejected. So we sent a new one about 2 months ago and are waiting for a reply..
