pre settlement apply from abroad

Hi
I would like to ask few questions
1. I m getting divorce and divorce papers will be with me on 2nd oct ( married in 2015 fab)
living together can I apply the pre Settlement now while divorce is under process ?
im non eu

2. I want to ask as can I apply from india as I have to travel in November so can I go to india now before 31st oct and apply from india ?

your help will me much appriciated
