Lieing on a VWP pass then applying for a Visa

Does lieing on a VWP visa effect a later on application for a visa where information such as criminal records are readily accessible?

I.e, does this count as misrepresentation, and is it standard procedure to dismiss such a claim for a visa by someone who has had a Visa Waiever and a criminal record? [not usually permitted]

If you are caught you could be banned from using the VWP or from entering the US (being denied a visa due to misrepresentation). The US take criminal convictions very seriously, and they are more than ready to ban you for a number of years from entering the country.
