TIER 2 APPLICATION REFUSED

Hi All,

I have applied for my Tier 2 General Leave before my student visa expires (27th July 2019). Basically I was switching my Tier 4 student visa to the Tier 2.

Unfortunately, my application was refused on the 13th September on basis of inappropriate salary.

SOC Code: 2129 (Engineering Professionals)
New Entrant: £27,400

On the COS certificate, it has been stated my working hours as being 45 Hrs per week which was a mistake from the HR department as the working hours should have been instead 40 Hrs. We applied for an administrative review saying that it was an honest mistake from the HR department and all but still on the 30th September I received a letter saying that my application is unsuccessful and I need to leave Uk and I have 14 days to explain any reason I have to stay in UK?

Can someone advise what can I do ? My student has expired already as said earlier and I was waiting to have feedback from the Home Office regarding the Tier 2 application. Now what can I do?

Please anyone who has been through this please help me thank you very much all.

Hello,

You have to leave the country within 14 days. Otherwise, you will become an overstayer and there is no way out once you get to that point. Just pack and leave.

Once back home, you can apply again for Tier 2 with the correct paperwork.

The salary is a non negotiable item in the Tier 2 application. If the salary is bellow the threshold, the HR cannot "fix it" by increasing the hours. There is no "mistake" concept when it comes to these critical details. Either they are entered right or there is a refusal.

Hope they will continue to support you and you can apply for the same visa from home.
