Non EEA (australian) - family permit

Post by Tom22 » Sat Jul 19, 2008 11:25 pm

My girfriend is from Estonia and I'll be flying there soon to get married.
We are planning to head for the UK afterwards.
She has never worked in the uk, is it true I can not apply for this visa since she has not worked in the UK for at least 12 months?
Is this visa the best option that we have?

thanks

I think she can study and thereby exercise a treaty right. Come to think of it I think she can anyway if she registers on the WRS.

As a spouse of an Estonian, you may apply for an EEA family permit. When in the UK, apply under European law.

Thank you guys for the prompt reply,
We have checked the links and came across the FMRS - Residence Stamp that I think it could be our best option

http://www.ukba.homeoffice.gov.uk/sitec ... a/fmrs.pdf

The form says that I can apply any time during my lawful stay in the UK.
Will be safe to assume that after getting married we could apply for the Residence Stamp within the UK when I just hold a tourist visa?
Also, if I'm granted the Residence Stamp will I be allowed to work or are there any restrictions.

Thanks
