Set(O) Spouse ILR Documents

Hi,

Following my previous question, we are filling in the Set(O) application for my spouse (I already have ILR, and she completes her 5 years in November).

I am a bit confused about the document requirements for this application.
I read about cohabitation proof requirements and finance proof.
However, the online form asks for the following documents only:
Mandatory documents
  • The passport [of applicant]
Other documents
  • Consent form for the Home Office to request verification checks on [me] for joint accounts or third party support
  • The degree certificate [of applicant] to prove the level of English language required
    Evidence of [of applicant]'s immigration status in the UK
  • Declaration signed by [me] to confirm consent for the Home Office to request verification checks
  • NARIC letter that confirms the qualification meets or exceeds the recognised standard of a Bachelor's or Masters degree or PhD in the UK AND confirm the level of English to which the degree was taught or researched
  • Current Biometric Residence Permit for [applicant]
  • All previous passports, travel documents or national identity cards that [applicant] have used to travel to or remain in the UK
Where can I find the exact list of documents needed?

Assuming you got your ILR via 5 year route and not LR.

You are applying ILR for your wife via PBS dependent route. Normally the word “spouse visa” is not used here as it gives an impression of a totally different route.

For a PBS dependent applying for ILR on SET(O), there is no financial requirement.

You however have to prove that you have had a subsisting relationship with your wife. You need last 2 years cohabitation documents to prove that.

Checklist is not always accurate. You should refer to the guidance.

Also, she needs to meet Life in UK and and English Requirement.

Yes, I received my ILR (through Tier-2 route, 5 yrs presence) on 15-Jul-19.

That's interesting because they ask for my consent for financial institution checks. Either ways not an issue, but needed to know what documents they want from the banks.

I have looked through this document previously, but didn't find any reference to documents that prove a subsisting relationship. Any pointers here would be greatly appreciated.

Yes, but they have updated the form and now ask for the Test Reference ID of LiTUT. So they seem to have finally managed the required integration between their system and the LiTUT system. So KoLL is satisfied.

Consent form has three parts. Sign only what applies. Applicant signs part 1. You will sign part 2 if she is depending on any joint account documents/bank account statements etc. Sign part 3 if applies.
This needs to be signed by you incase you choose to submit joint bank accounts etc satisfying the cohab docs requirements. If not, no need.

Did not understand your last part. But Life in UK and English Level B1 is mandatory. That should show up in the checklist also.

I think this is something that changed in the last few days only.
Originally, the document list in the form mentioned the "Life in the UK Test pass notification" apart from English language requirements.
When I accessed it today, a notification said the form was incomplete due to recent changes. The new section which was blank was the one asking for the LitUT Test Reference ID. The "Life in the UK Test pass notification" was removed from the documents list.

Obviously, for our case, spouse has passed the test and has a Masters equivalent validated by NARIC.

That is the cohabitation documents. This forum has numerous threads on this topic if you search.

You need last 2 years cohab documents from 3/4 different sources evenly spread across the last 2 years i.e. every 3/4 months.

Ideally a couple docs in joint names. Otherwise top it up with documents in solo names but same address.

Tenancy agreement
Bills - Elec/Gas/Water etc
Council Tax bills
NHS letters
Joint bank accounts
UK driving license
Sky/Virgin Media
TV license
etc etc
