Did my fiance overstay?

Did my fiance overstay?

Hi! Thanks for your time.

So my fiance came to UK on a spousal visa with T in May 2018. He called off the relationship in Sept 2018 and she moved out of their home. She stayed in the UK initially because she wasn't sure if her marriage would get back on track. We met Nov 18 and started dating Dec 18.

She didn't advised Home Office her marriage had ended until April 19, and was told to leave by June 19, but left mid May 19.

If she moved out in Sept 18, did she have to tell HO then? As in will they penalise her for taking 7 months to say her marriage was over, whilst starting a new relationship with someone else in the last 4 months of those 7.
