Advice on my girlfriend...

Advice on my girlfriend...

Right she's American born and she lived there until she was about 4 when her family brought her to the UK. Her parents are from the UK and are considered British citizens though they dont know of any forms or documents to state that my girlfriend is allowed in this country.

Now she has just applied for a job and they are requesting any forms if the person is not English as well as having to present English passport and birth certificate which as of yet she has neither.

So my 1st query is, is she legal to live and work in the UK? I presume so due to parents, she is currently 16 and has lived here since she was 4 with one return vacation to the USA since.

My 2nd query is, if she is actually legal then how can she go about getting the relevant forms and documents?

(She does have and own a National Insurance Card + Number)

When and where were her parents born? How did they obtain British citizenship?

Since she is under 18 and both her and her parents have been living in the UK for more than 4 years, there shouldn't be a problem. This is contingent on her parents being British Citizens by descendant and that the application is received prior to the child's 18th birthday.

As for her parents, they are both of British citizenship as they were both born here, close to birmingham some 35 odd years ago

In which case I think she is British by descent, as her parents are British otherwise than by descent. This basically means that she is already a British citizen. I think she can just apply for a passport.

I'm not sure if she needs to do something beforehand, though....others can chip in.
