Leave to remain for baby born in the UK

I have leave to remain based on FLR under 10 years parent route. I was granted limited leave last December as a single mother. I was destitute at that time and I applied for fee waiver and was granted recourse to public funds. My daughter who is 10 years old next month is eligible to be registered as British. I am currently 8 months pregnant and my husband(we are only religiously married) has overstayed his visa.

I am planning to travel to my home country next year and would need to apply for leave to remain for the baby. I am unsure about how to go ahead with the application since my husband’s name would be on the birth certificate and he has no legal status in the country( we plan to apply for him under private life once we are ready with the documents and finance). I understand that the parent‘s route is for single parents only? I do not want to apply as a single parent by omitting my husband’s name as apart from the fact that it’s misrepresentation, it will also be an issue later on when we file his application later next year. Can anyone please advise me on this matter ?
