Date of submitting application VS date received by HO

Hi,

I have submitted and paid for my application on 13 Dec 2019.
(I received an email from noreply@visas-immigration.service.gov.uk with the subject "UK visa application: payment confirmation"

I was away on holiday from 14 Dec 2016 - 2 Jan 2017.

I have received an email from HO on 16 Dec 2019 saying below
"Thank you for your application to the Home Office. Your application has been received and is being considered."

Does that mean I failed to be present in the UK and my application will be rejected??

No, your date of application is when you paid and submitted, not when you received the email which is a generic email and usually is received after a few days.

Below is what I extracted from the guidance.

The residence requirements:
You must have been physically present in England, Wales, Scotland, Northern Ireland, the Isle of Man or the Channel Islands on the day 3 years before the application is received by the Home Office.
• For example, if your application is received on 05/05/2019, you should have been physically present in the UK on 05/05/2016.
• Most applications that fail do so because applicants have applied even though they cannot satisfy the residence requirement to be present in the UK at the beginning of the residential qualifying period.

So does that mean I will fail?

NO - you were present in the country on 13 Dec 2016 - the date of the email is irrelevant as stated previously.
