[Sunrider Singh] I I want to ask your experience

Post by tabbington007 » Wed Dec 18, 2019 10:01 am

Hi, I am the non EU citizen spouse of British person.
We are living in the Republic of Ireland for the last 3 years. I am currently working as full time and my Spouse will finish her degree this June.

We contacted a Solicitor to arrange Surinder Singh route, and seems everything okay so far but my concern is I have stamp4 EEA FAM in Ireland which guaranteed 5 years.

I know I have to enter the UK with my spouse to find place and job once we got 6 months and have to apply Surinder Singh, however no one knows how long it takes and there is always a chance to be rejected, and in that case we have already left Ireland for more than 6 months so I am worrying that I'm going to lose my EEA family permit in Ireland and also at the same time there is chance that Surinder Singh won't work.

Has anybody ever gone through a situation like us? I believe a majority of people who applied Surinder Singh are like us who have an EEA family permit in other EU country and came to UK with 6 months.
So I want to ask advice or any experience that you can share with me because you guys also had to leave your host country and have to wait until your proper 5 year visa

It would be great to hear your experience

Thanks :D

Your concerns are valid, if you were to remain outside Ireland for more than 6 months, your right of residence in Ireland may be lost. However if you've lived in Ireland for 3 years and have exercised treaty rights for majority of that period, I won't worry about anything going wrong. Moreover that length of residence in Ireland makes a right of residence confirmation in the UK a mandatory obligation.
