Spouse visa for self-employed with less than 1year

Hello All,

Thank you for all your help.

Little background on my case.. I’m married to my husband on 2013 and was in UK with my husband. I stayed in india for 1yr on 2016 for pregnancy. Again i came to india for a year for my son’s treatment from Jan-2019 and im still in india. My spouse visa expired on Dec 2019.

My husband, british-citizen from 2016, started self employment [director of private company] on April 2019 and now from reading official guidelines i understand that he needs to be in that self-employed business for at least 12months meaning we can only apply spouse visa only on March2020.

Some of my friends told that we can apply spouse visa based on the fact that my husband was on employed company until April2019 and self-employed then on until now Dec2019. So there is no break on employment history. I’m not sure whether we can take a chance or wait until March 2020.

Kindly advise please.

Have a read of the guidance document linked below:

Income from self-employment is considered under Category F or G and income from the last full financial year (Category F) or average of the last two financial years (Category G) must meet the financial requirement. Any other employment income being combined with the self-employment income must be from the same financial years being considered. Additionally, there is much evidence that is required to be provided in support of self-employment income as outlined on pages 64-65 of the guidance document.

If you are using other employment income in addition to the self-employment income, you would have to provide evidence of ongoing employment at the date of application (Section 9.3.9 of the guidance document).
