son of a british citizen father

hi all. i am new and i have been searching for post related to my question but most of the topics are locked.

if any body could advice me please. my older brother was a British citizen and he went to visit Bangladesh and had a child without getting married. he has (child's father) passed away few years ago.

i was wondering is there any chance of bringing the child over to UK as he has no way of supporting himself (11 year old) the mother has got married to some one and the husband will no accept him.
i have no paperwork for any DNA. could i give DNA as an uncle to proof that is my nephew.

any guidance will be appropriated

my brother was British before the child was born. he was naturalised as British in around 1976-1979. the child was born 2008.
father's name is mentioned in the child's birth certificate. previously my brother was married in the UK but marriage broke down. after 4 years of separation but the divorce papers did not finalized. and he wanted to marry the childs mother but dead before both(divorce papers and new marriage)

i also heard you need a DNA test to proof he child was his. there was no DNA test done. could i provide my DNA (uncle) will this be good enough

DNA can not be required. Presenting proof that the Father was British otherwise than by descent and that he was the Father (birth certificate) should be sufficient for a British passport to be granted.

sounds good. so if i get him a british passport(with all the applications and proof of documents) i can bring him over to UK

The issue may be with getting the Mother’s consent to remove the child? Assuming you have written and certified consent to do so, a British child can enter the UK freely. You may be interviewed (including by the police) on entry. I suggest also getting PR (or adoption) again certified by the Court.

currently i am trying to make her understand how he will be in safe hands with me. i am trying to make her understand that she has moved on with some body who is not accepting the child and is getting treated badly. she has agreed to let me bring him with condition that i sign a document that he will be allowed to visit her, which i do not have a problem with. lets see how it all works out. i have also found out, my brothers documents are all missing. passport, citizenship certificate. as he took them with him to Bangladesh. after his death, they just didnt think to keep them safe. is there any way i can obtain them from the British passport office or any other source

There may be Data Protection Act implications of government departments releasing documents of a deceased person to somebody else (even a family member) and they may be hesitant and/or slow in this regards.

EDIT: As your brother was naturalised before 1986, the naturalisation records will be with the National Archives and you may (not sure) be able to get a copy from them.

A further wrinkle is that pre-1983, Commonwealth citizens used to be registered as British citizens rather than naturalised. Therefore you may have to look through registration records as well as naturalisation records.
