knowledge of English requirement as part of an indefinite leave application made on or after 28 October 2013?

Post by KLIM_2 » Fri Jan 03, 2020 1:54 pm

Hi,

I am a naturalised British Citizen since 2006. My wife came to UK in 2014 with a "VISA SPOUSE/CP" valid 2.5 years. At that time, she met the English Language requirement at level A1. In 2017, she applied for a 2.5 years extension through the Family Route visa. For that visa, she met the English Language requirement at level A2. Now that the 5 years are complete, she is applying for Indefinite Leave to Remain. She has passed the "life in the UK Test" and an IELTS Life Skills test at level B1.

When trying to apply we have stumbled on a few questions about the language requirement and the required form in general.

1) We are applying using for SET(M) as a partner of a person present and settled in the UK - 5-year route. We think that is the correct form based on our history laid out above. Can anybody confirm that this is the current form to use in our case?

2) When applying online we have come across the following question in the form: "Did you meet the knowledge of English requirement as part of an indefinite leave application made on or after 28 October 2013?" at first we answered "Yes" but before paying and submitting the application we have noticed that at no point have we been asked to enter the reference number proving that the language requirement have been met (i.e. the IELTS Life Skills test in our case). We thought that maybe we should have answered "No" to that question given that we have never applied for an indefinite leave before. We went through the application again and found that before paying and submitting the application we still are not being asked to enter the reference number proving that the language requirement have been met. In both cases, at no point have we been asked to provide evidence of the language requirement as well in the documents section of the application.

Does anybody know how to handle this question?

Thanks for your help

SET(M) is correct.
There is an error on the online form regarding English language question: indefinite-leave-to-remain/ilr-english- ... l#p1854796
