Appeal allowed but just had a baby

Thank you in advance for reading my message. My friend applied for a spouse visa for his wife who is in Nigeria in November 2018 and though the visa was refused, her appeal has been allowed after so many months in waiting. However, as they been waiting for a response from the court and home office, she gave birth to their first child, a daughter. My friend is a british citizen other than by descent before his daughter was born. His wife has been advised to visit the high commission with her passport. I am just looking for advice from the gurus on what he should do now. Hopefully a good Samaritan will respond to me quickly as time is of the essence.

If the child’s parent is British otherwise than by descent, then the child, born abroad, is British by descent and needs to apply for their British Passport to travel to the UK or a Confirmation of the right of Abode.

Congratulations to you your friend! I would strongly advice your friend to get her MP involve in this to help speed up the process because after submission of passport, it usually take 4-8 weeks to get the passport back so I will certainly recommend your friend giving it a try as MP has a special desk with the HO.


It is also difficult because she can’t leave her baby back in Nigeria in the case her passport is ready. Although it is difficult to do since she has to apply for British passport for the child from abroad. It’s a difficult decision for your friend to make, she can either leave her baby for 2 days to pick up her BRP and return back to Nigeria to apply for BC for the child because the child will be british citizen by descent.
