Post by evibebi » Thu Jan 16, 2020 4:35 pm

Hello I am moving to UK just before Brexit and I will applt to EU settlement Status. But I have to leave the country before 31 January because of my family. How should I register myself as a resident that I can apply pre settle status Do I need to notify anywhere that I live in UK?

Refer to: https://www.gov.uk/settled-status-eu-ci ... atus-means
Note that settled status is under UK regulations, not EU.

There is no way of "registering as UK resident" other than applying for Pre Settled Status (or the soon-to-be retired EEA QP card). So a Pre-Settled status application is the actual way of making yourself known to the Home Office as UK resident.

The onus is on you to collect enough evidence that you moved to the UK before the applicable deadline (National Insurance Number having received contributions from your employer, plane tickets, registration with a GP, rental contract, payslips, bank account...).

Good news is, there is only a deadline for your moving to the UK if the UK leaves the EU without a deal. For more on what deadlines apply when, visit: https://www.gov.uk/settled-status-eu-citizens-families

Hello,

Thank you very much.I am planning to stay in hotels or Airbnb unless I find a job. I will use plane tickets as an evidence and maybe a few more thing. However I will not have a permanent adress immediately. I will apply before 31 January just in case. While I apply, what should I write for my address in UK? Can I write my Finland adress?

Hello

If your idea is to spend 3 days as a tourist before Jan 31, apply for pre-settlement and go back to your country, it's not going to work.

You have to come to the UK with the intention to settle and that's different from spending a short time in an Airbnb then leaving. A tourist is not exercising treaty rights.

As the previous poster said, the burden of proof is on you, not on the Home Office. You have to be able that you entered the UK before the Brexit date and started exercising treaty right. It means mainly either working or registered with a Job Center as Job Seeker... etc. If your intention is to move to the UK to live, you can rent a room in a shared accommodation or rent a studio. Go to the Job Center and book an appointment for a national insurance number, start looking for job... etc.

But if you just show a plane ticket and 3-day Airbnb booking, you just demonstrated that you are a tourist.

Thank you for your answer. My aim is settling UK in 6 months but I have to go back now because of my non eu spouse. Due to no deal Brexit, I want to enter UK before 31 January. I need to bring my family and also find a job in this 6 montha. I will definetely go to Job center as you adviced. But I dont know how easily I can find a place for living with my family in that short time.
As you said in pratical showing place tickets is a tourist status. But in Home Office web site , it is written that showing 1 evidence is enough to apply for pre status.Even flight tickets is given as an example of evidence that you lived 1 month in UK.
