Hi all,

Can anyone tell me step-by-step, the process of the registration of marriage at a commune in Albania.

What do you actually do? Is it simply going with 2 non-family witnesses to the Commune and signing a piece of paper or do you have to do/say anything?

I am asking as I am British and do not speak Albanian. We have all the necessary docs/certifications this is just to ask about the registration of marriage procedure at the comune after the 11 days and giving notice etc.

Hey I can help you!

I got married last year in Albania and my husband received his visa today.

The marriage part is very simple.

You need CNI (apostiled) from U.K.
Your birth certificate (a certified copy - not the original as they will keep this (mistake I made!!!)). This also needs apostilled.
Proof of your address e.g bank statement (also apostilled). I brought a bank statement without the apostille and it took us some persuading to get them to accept this.

These all need to be taken to a noter when you arrive in Albania. You can find these in any city. They will translate them for a small fee.

Take these to the commune.

You will need 2 witnesses and a translator for the ‘ceremony’. The commune should have a list of local translators. The commune will check your documents and will book you a time for all this in I think 10 days. The witnesses can be anyone. The most expensive part of the process is the translator (who doesn’t do much really as certificate is in multiple languages anyway).

For the ceremony you just sign a bit of paper and that’s it. Married!

After that they will issue your marriage certificate. I kept my maiden name on it for now. You can pay for some more copies. We got 4. We then sent 3 of these off to be apostilled in Albania. This takes about a week and is quite expensive (including postage I think it was £50 per certificate - the noter did this for us).

We didn’t even have a ceremony or take any pictures and got the visa. No phone call nothing. Don’t feel pressured to have a big wedding. If you have strong evidence of your time together in U.K. it will be enough.

Also don’t worry about Your husband being in the U.K. ilegally. If they voluntarily left and have no criminal / nhs record you will have no problem.

I have a couple of questions:
- Is the translator required if my fiance can translate for me/marriage certificate is in English?
My fiance's relative is going to the commune for us with our documents to give notice of marriage and translate everything before we fly over. He gave his consent for her to do this at the Albanian Embassy in the UK.
I am waiting for CNI to be ready and I already have my birth certificate certified.

- Can you get the marriage certificate apostilled on the day at the Embassy or somewhere? I was told by my solicitor that I just need to return to the UK to translate the certificate he didnt mentioned it needed to be certified so thanks for this info!

We will be applying for the spouse visa once I return to the UK, hopefully end of March. My fiance is an overstayer. He was caught with fake ID coming into the UK from an EU country and was sent back to that EU country (not back to Albania) he wasn't arrested or convicted of anything though just detained at the airport and flown back to the EU country he flew into UK from. He then made his way to the UK undetected and has been here for a few years. He will be returning voluntarily next month. We will be declaring all immigration history on the application. What do you think our chances are? He doesn't have any criminal convictions. We have tons of evidence of our relationship and I meet the financial requirement. We have supporting letters and we have a joint tenancy and utility bills all in both of our names. He also has a letter from a company saying he has a job for him when he returns.

So I didn’t realise we needed a translator until we got there. The translator had to be an approved one (even though everyone at the ceremony was English speaking). She signed something for the commune. It could have been specific to that commune? I can’t speak for other ones. But if it is the case it is very easy to organise.

Make sure it is not your original birth certificate! Or you will not see it again.

So I do not think the certificate needs to be apostilled per se for the spouse visa. I did it as if you you google it, it makes the document more official and just better in my opinion. The noter also recommended it. If you wanted to use the certificate in England for proof of marriage for certain things I do think it helps. But I can’t speak 100 percent on that. While it was sent off I returned to the U.K. and then my husband sent this by post to me.

Certificate does not need to be translated. It comes in like 5 languages.

I think your chances are very very good. I spent the whole time panicking waiting for rejection or even an interview and it was all fine! Voluntarily leaving looks good in itself and if you are in a genuine relationship and meet all the criteria they have no grounds for rejection. Even if they say we think he entered fraudulently they have no proof for this and this would not even go to appeal as it is a waffle response.

Yes I was like that. Spent so much money on things that probably weren’t necessary but better to be safe then sorry!

So he was away for 16 weeks. However TLS messed up our supporting documents. They didn’t scan them until 9 weeks after we sent them and so our application was delayed by this (I was so furious - I am going to make a massive complaint). So minusing that massive error it took 7 weeks from them receiving my documents - and we paid priority. I visited him every 2/3 weeks during this time.

Good luck with everything! It will be worth it and the time will go super quick. Have a lovely trip to Albania xx

Hi, I will be sponsoring my husband in his spouse visa application next month. He is an overstayer and he had a GP appointment once in 2017 and a dentist appointment once in 2018 only. He paid for the dentist appointment but was this a levied charge as he was registered as an NHS patient? It was a tooth extraction. The GP appointment was once for ear pain but he wasn’t prescribed anything. What do we do, how much will this amount to? I heard anything under £500 won’t affect application. It was just those two appointments.

I can answer half of this.

Dentist will not matter. My husband had some NHS dentist work (and paid the nhs price). I didn’t declare this on my application. Also with dentists you do not need an nhs number to attend and they do not check ID so it’s completely unregulated.

With the gp I am not sure. Maybe just declare it on your application that he went to the GP once although I think NHS fees only apply for secondary care (treatment in hospital).

Thanks Rosie. I think you're right. I spoke with my solicitor earlier and he said that it is just for hospital secondary care.
