British citizen marrying illegal immigrant in USA to immigrate to the UK

My Partner overstayed his visitors visa (B1/B2) in America. He got married to an American citizen and was granted an Employment Authorization document (EAD) this allows him to work legally until end of 2020.

Is it possible for me ( A British citizen) to marry him in America and apply for spouse visa for him to settle in the UK whilst he is in America without him going back to his home country.

Is an employment authorization considered legal status since he is able to work in USA legally?

Can I just ask, is this a genuine relationship/marriage? Because that's what you'll have to prove.

Yes it is a genuine relationship. Have loads of pictures, videos, messages, plane tickets, receipts. What else would we need to show that our relationship is genuine ?
