Spouse visa ILR qualifying period ?

Post by sherb » Tue Feb 25, 2020 1:47 am

Hi ,
I got my entry clearance on 21-04-2015 valid up to
21-01-2018,
I entered the country on 15-05-2015.
Got my grant of leave to remain on 09-02-2018 valid until 02-09-2020.
I’m applying for ILR under 5 year partner route. (Married to a British Citizen)
I passed my GESE Grade 5 (B1) on 01-2-2020
Passed life in the UK test on 08-2-2020

Can you please let me know -

1) what is the qualifying period to apply for ILR ?
I complete my 60 month of entering the UK on 15-5-2020. Should I apply 28 days before that or apply 28 days before 02-09-2020 ?

2) My daughter arrived in the UK on 22-07-2015, her BRP is valid up to 2-09-2020.
Can I apply for her ILR with me ?
Can I apply on my own and later apply for hers in June 2020 ?

Regards
Sherb

1. 28 days from your 5 year anniversary since entering the UK
2. You can apply together

Thank you Zimba for the quick reply.
Regarding 2nd question , my daughter will not complete 60 months if she apply with me in April 2020. I was thinking of applying in April and later for her when she reached the 60 month period. Is that allowed ?

Children do NOT have a qualifying period requirement. Non UK born children will follow the immigration path of the less privileged parent. Children can get ILR when both parents are settled regardless of how long they have been in the UK
