Child passport Query

Dear All,

Our work permit started in May 2003 and our daughter was born in June 2003 in UK. We got our ILR in June 2008. I applied for my daughter's British Passport last week. Today I received a reply that they can't process the case as at the time of her Birth, her parents did not have ILR or British Passport.

I am not too sure about the law, but it is common sense that she is eligible for passport as we got ILR now. If we had ILR at the time of her birth we could have applied at that time.

Can you please provide me a link to the relevant guideline that I could send them via post.

You can't directly apply for British passport....!!! First you need to register your child as British using MN1 Form and by paying around £400.....Once your child registered then you can apply for Britsh passport ....!!!

Your daughter first needs to be registered as a British citizen.

See Form MN1 and the accompanying Guide MN1 — also available via this page. Unfortunately, registration of a child attracts a fee, which is not insubstantial — £400. However, I imagine that you will think that it is worth the fee for her.

As you imply, if you have any further children in the UK while you have ILR (or indeed if you become British citizens), those children will be British citizens at birth automatically.

Many thanks for your detailed reply.

Yes I have checked the forms and I would be able to do then asap. Now my concern is what will happen to our documents that we already submitted for Passport, and fee. Would they hold the case unless we get registration process done?
Also how long it could take to the registration
and finally, I wonder, why passport office did not mention that we need to register first. They just ask the proof of our residace at the time of her birth.....

This year, my children received their Certificates of Registration in less than four weeks with a regular postal application.

If you are concerned about speed, then review the nationality case guidance instructions and follow what they look for exactly.

You may also want to prepare a detailed cover letter that lists what section you are applying under and how the child meets each of the criteria.

Make sure your appliction is incredibly neet and easy to read. I submitted a typed in application.

It is my understanding that the passport fee is in fact for the provision of the passport, rather than for making the application (in contrast, say, to immigration of naturalisation applications), so I believe that the fee should not be charged in this case since no passport could be issued.

The documents ought to be returned to you. Once you have the certificate of registration you will be able to make a fresh application.

Used to be the case until recently, but has changed:

you are right JAJ, I rang passport office and they said the fee is for processing of the case and as your case has been processed so your fee is lost. Once you get registered you have to send a new application.

Post office provides a check and sign service in which they verify all of your documents and charge you a fee of £7. I use their service and paid them money as they told me that my case is complete and every document is attached with the application. Can I go back to post office and ask for refund on passport fee as because of their mistake I did not sent all documents........

As per guidance I am filling in form MN1. I have completed almost all the sections relevant to me, excluding section 2 where it asks for residence requirements.
Is this section for those who were born outside uk only or for those who are born in UK as well?

Just confused :roll: :roll:

Also in list of documents it just asked for child's birth certificate, previous passports and child's parents marriage certificate. I am also told by some one to send at least one passport of child parent as well? is this right?
