Few questions of clarification before I submit

Post by joylandlocked » Sun Mar 01, 2020 4:13 pm

Hi All,

I just want to clarify a few points before I submit and pay for the application tomorrow.

1. I’ve seen people already ask if should click yes to the question “Are you either:
• An EEA national who has been issued with a permanent residence document
• A family member of an EEA national who has been issued with a permanent residence card”
But if I clicked yes it asked if I’ll use settled status and no where else does it ask that if I click no. Why should I click no? This isn’t clear to me.

Further to that point If I click no it the documents asked to provide are:

Miss ____’s proof of freedom from immigration time restrictions
You must provide one of the following documents:
• your passport showing you are able to remain permanently in the UK
• other (for example, a letter from the Home Office, your BRP card or other proof of exemption from immigration control)

If I click yes it says:

Miss ______’s proof of Nationality
You must include your:
• passport or EEA national identity card
• UK permanent residence card
• evidence of freedom from immigration time restrictions

It then becomes clear why I should not click this option as I cannot provide a permanent residence document, but then why does it allow the option to use settled status when you click it? Very confusing.

2. How do I prove my settled status? I understand it is linked to my passport, but other than that I have nothing else. I have the letter provided to me notifying me my application was successful but that is not proof of status as it states in the letter. Should I use it anyway?

3. The requirement to be physically present confuses me. Do I need to provide proof I was in the UK on the 2nd of March 2015. I know I was, so are my letters from school/university proving residency enough?

Thank you all for reading and answering my questions.

I believe if you have settle status the answer is NO. It would then ask you about what type ILR you have, incl. settled status.

Further to that point If I click no it the documents asked to provide are:

Miss ____’s proof of freedom from immigration time restrictions

Not familiar with what you get with settled status - do you have a reference number you should provide if you need to prove your settled status? If yes quote that, alternatively just provide a copy of the email. Your status should be online of course.

3. The requirement to be physically present confuses me. Do I need to provide proof I was in the UK on the 2nd of March 2015. I know I was, so are my letters from school/university proving residency enough?
You don't need to prove that you were present - which you were. It's a requirement in law.

Thank you all for reading and answering my questions.

Apologies, I got confused with the answers you have explained and as I understand it - we don't have sight of the input options.
So I'm confused myself .... can't give a firm answer to your point 1.

Thank you for you response.

If you say yes to

“ Are you either:
An EEA national who has been issued with a permanent residence document
A family member of an EEA national who has been issued with a permanent residence card”

It then says

“What will you use to apply for British citizenship?(Required)

1. Permanent residence card or document

2. Indefinite leave to remain (ILR), including ILR granted under the EU Settlement Scheme”

If I click the second option it then says:

“Date your leave was granted (if known) (Required)
Enter date in the format DD MM YYYY”

My assumption is if you’re using settled status to apply you would select this option?

Number 2 would then be the option to choose, ILR under Settled Status.
