Spouse Visa from Tier 2 to ILR

Post by syedkm786 » Thu Mar 12, 2020 3:33 pm

Hi

My wife came in 2018 on as PBS dependant when I had Tier 2 Genaral. I got my ILR in april 2019 and my wife's visa is now going to expire next month.

I want to ask that where should she apply now and to get either a renewal or does she have to apply as family of settled person?

I am confused, someone please guide.

Unless you were granted ILR under 10 years long residence, your wife should continue to extend her visa as a PBS Dependant. Switching to a FLR(M) spouse visa would re-set her immigration clock to zero, putting her on a new 5 year path to settlement (ILR)
