Changes of status (legal,Illigal) and ILR

Post by better_life » Mon Aug 11, 2008 12:07 pm

Hello everyone,
Please advise me in this regard.I came to the U.K.on 2000 as a student.I applied to extend my student visa on sept.2001 within the U.K. but didn't hear from HO until July 2005 despite my numerous calls and letters.I was in full time study till 2002 but did not attend university on full time basis after 2002 as i had already completed all the taught course of my masters degree and i was writing my dissertation which did not require me to attend the classes.Due to the uncertainity of my passports and visa ,i thought it wouldn't be a good idea to pursue further studies as lack of passport and visa would severely hamper my research studies which would involve frequent travels. I subsequently graduated on July 2005 after completing and submitting dissertation.
I suddenly received a letter from HO stating that they lost my passport and other documents and that i have to approach to my embassy to make anew passport. I then made a new passport and apllied for SEGS(Science and graduate scheme) which was granted to me on Jan 2006 .The residence permit was given under segs and was about 1year till jan 18 2007.I then switched back to student status within the U.K.and am in full time studies since then. I have travelled outside uk two times after i got my passport and visa i.e once in 20o6 and once in 2007 spending 80 days in total.
Given the complexity of my case, i am wondering if i can apply for ILR when my 10 years time completes that is on 2010 or I have to wait for 14 years.
Although i stayed without passport and visa in the U.K. for sometime ,that was not deliberately done from my side but was compelled as my passport was held by HO before finally loosing it by them.
Please advise me.

You are still on track for your 10 year ILR - assuming the rules do not change before 2010.

I guess we can only be sure about this if the OP applied for the renewal before the expiry of the LTR and the HO does not have any gap in the OP's history.

I will advise the OP to make a SAR request as the first step and take it from there.
Praise The Lord!!!!
