Had ILR before

Hey there
I wonder if someone can suggest me,i lived in UK from 2002 till 2009 and I had ilr. I left and didn't come back for few years and got married in India, as I wasn't aware of the rules of 2 years when I wanted to come back I applied for returning resident And I got the Visa 2019 September I came back a week after as it had 6 month validity on it,my child was born here on 03 Nov 2019 so I wanted to know what nationality would my child get as I received my brrp in March

Your child is born to a settled parent in the UK and therefore the child is British at birth. The child can get British passport now

Thanks for your reply... My only concern is that I came back after 8 years and my ilr was on my previous passport which has expired with my old name as I m married now so I have different passport,and my child was born between when I was waiting for my brp,and on my passport it had returning resident written on it with valid until six months, when I applied for my child s passport now they said they need settled status while my child was born so where do I stand. I'm very confused

Returning resident visa is ONLY granted to those who have settled status to enter the UK. Your child was born when you were settled. Your old passport and marriage are irrelevant

Like I said I wasn't here for last 8 years ,it's only when I got my RR in September I came back and in Nov my child were born, so why is it that I have, applied for his assort now and they have asked me to send documents to prove what was my status when he was born.i have already sent them my brother which is valid from March and passport which had returning resident with 6 month validity bow they want more documents. So how can I prove it

As I said returning resident visa is only granted to people with settled status. Your visa is the proof you were settled in the UK at the time of birth.
Evidence of a person’s settled status in the UK is normally found in the applicant’s passport, on an immigration status document or a biometric residence permit (BRP).These documents may include the following:

• indefinite leave to enter (ILE) endorsement or BRP
• indefinite leave to remain (ILR) endorsement or BRP
• no time limit endorsement or BRP
• returning resident visas
• open date stamps in passport after ILE/ILR has been granted
If such evidence cannot be provided, a person’s settled status may still be confirmed through:
• records on databases, such as central reference system (CRS) or case information database (CID), or paper files that show indefinite leave has been
granted
• other proof the applicant was settled in the UK on or before 1 January 1973 and this status has not been lost or revoked

Well thank you for the information I have sent them my old passport now and my marriage certificate as I already sent my new passport and biomrtric but they wanted more proof so let's see.. Hope they don't come up with something new.. You been really helpful thank you
