Tourist Visa UK

Post by cherryblossom2008 » Tue Aug 12, 2008 3:41 pm

I am currently working in Belgium. Have been working here for over a year. I am originally from India and would like to travel to the UK as a tourist. I have studied in The UK in the past and even worked there. My work permit then was valid for 2 years. I was laid off from my job after 8 months though. But when I was laid off from my job in The UK I stayed there for nearly 4 months after being laid off. This was 5 years ago.

Will this impact my application for a tourist visa now?

So, you had a work permit (and presumably Leave to Enter/Remain) for 2 years, but you only stayed a year? Was your Leave curtailed? If not, you could not be classed as an overstayer, and it's not unreasonable to argue (if you had to) that after the job disappeared unexpectedly after such a relatively short time you needed a while to sort your affairs out before leaving voluntarily.

If your present employment in Belgium is secure I don't think you should have any trouble in getting a visit visa for the UK

I had my work permit for 2 years but lost my job after 8 months. I stayed after that for 4 more months. When I left, there was still a year left on my visa (though it was tied to my work permit). I don't know if my leave was curtailed. I did not recieve any notification from the Home Office informing me that my leave was cusrtailed.

My present job is a secure one . Its a permanent job and its well paid.

Based on my stay in the UK after I was laid off there for 4 months after termination of employement, will I be classified as an overstayer? If so will it affect my present chances of getting a tourist visa?

I don't think you'll have any problem at all. Even if your employer notified the Home Office and they decided to curtail your leave, (which I think is unlikely), you probably left before they got around to doing anything about it. So you haven't committed any offence. Your job didn't work out, and you left the UK without being asked to. I doubt whether you'll even be asked about it, but have the details ready, including any documentary evidence, date stamps in your passport, etc.
