Tier 1 in process - when to apply for dependents?

Post by philpott555 » Wed Aug 06, 2008 2:29 pm

Hello All,

I will need to go to the UK from the US immediately after receiving my Tier 1 (General) visa. However, my dependents will also require a visa (wife and 2 children). I see three options:

1) Apply while in the United States and delay their entry. However they might have to wait 5 to 6 weeks. Is this correct?

2) Dependents enter the UK on a visitor visa and then apply from the UK for a change to the Tier 1 Dependent visa. Is this possible? Will it prevent the children from attending school or getting health care?

3) Dependents enter the UK on a visitor visa and return to the US to apply for their Tier 1 dependent visas - waiting for 5 to 6 weeks. This seems to be the simplest option, but I am still concerned about the health care/school question from #2 if they are present in the UK under a visitor visa.

Thank you.

If you have dependants who wish to join or remain with you in United Kingdom, you or they should complete the separate dependant application form.

We encourage you to send dependant applications at the same time as the main application.

Dependants should state if they are submitting their application at the same time as your application. This tells us that both applications should be considered together.

If you are the main applicant and you have already received official notification from us that your application has been successful, this should also be indicated in this section.

Dependants should also state the category under which you have submitted an application.
2) I don't think that visitors may switch to Tier 1 (General) dependant in the UK.

Hi Vinny,

I checked and you are correct. They either have to apply once my visa has been received or they have to return within 6 months (since they would be under a tourist visa) and submit their passports for the application process.

thank you.

Matt
