Green Card through marriage

Post by green-card » Sun Aug 10, 2008 6:22 pm

Hello, I'm in the US as a tourist and I met someone and we want to get married to her and live in the US together.
I have two questions:
1) Can I marry her in the US or I have to come back to my country and get a K1 visa? I would prefer to marry her on a tourist visa and not leave the US, is that possible?
2) How long will that take me to get a Conditional Green-Card? and can I work until I get it?
3) If we get married now, how long will that take me until I recive a Permenent Green-Card?

Thank you and have a good day.

You mean you just met someone and want to get married? Isn't that a little quick for a lifetime commitment?

1) As far as I know it is not recommended, but if you prove that you entered the US without the intent to get married you should be fine. I personally know 3 ppl who came to the US as students and got married and got green card.

2) It can take anything from 4-5 months to couple of years. Usually takes longer if there is extensive background check on you (if your name comes up on red list or whatever) I think on average now it should be about 9-12 months. It took me 6. Yes, you can get work permit for a year while your application is pending: you can renew it if you don't get green card within a year.

3) 2 years after you get your conditional card.

While marrying while in the US on a visa other than the Fiance visa can happen without any issues, the one that is specifically mentioned in regards to marrying in the US is the tourist visa. The only time this should be used is if you are returning to your home country. From what I remember, you don't have to be in your country to file it. Your fiance can file for the visa in the US while you are there, but you must return to you home country to pick it up.

Thanks. What is that red list that can cause a huge delay?

Well, normally if you're not from a country that sponsors terrorism, if your name doesn't match name of some terrorist and you don't have criminal history, you should be good.

I'm not from a country that sponsors terrorism, I'm from European decent and I never even got a parking ticket. I think that I'll be fine then, thanks.
It will help if I contact the police in my country and asked them to send me a letter that say that I have no criminal record ect' ?

I don't know: I read a lot about people getting those letters, but honestly i never seen that as a requirement for green card and I didn't submit one either.
