This is my first post on immigrationboards.
I was about to apply for BC on the 16th November 2015, the the register officer told me that the Citizenship law have changed on November 12th, just few days before. The new rule was that EEA needed to apply first for the DCPR card ( Document Certifying Permanent Residence ) and send it with the BC application.
I did apply 3 times for the DCPR , and I even appealed the last refusal but still couldn't get it approved.
The first time I waited from December 2015 to August 2016, the seconds was over 4 months wait. The third time was 5 months and for the appeal was 4 months. You can't imagine the stress the HO gave me. The first time I applied, I had to write to the HO to ask for my passport for them to send me the passport with the refusal letter that they have already written 7 months before . They make me wait for nothing for over 7 months.
4 years 3 months later I got the settled status. One year later I applied for the BC and I have been waiting for a result for over 4 months now

Thanks. It is a bit more complicated: I had CSI via my Italian EHIC, but my wallet was stolen in 2013, so had no chance to prove it until I received a new card later on in the year. I also had a dependent family member insurance through my father, but only managed to obtain information for two of the past six years.

In short, while I had it, it would have been awkward to prove I had it.

I means you actually were covered, but you didn’t provide anything with your application or saying in your cover letter and also weren’t asked to?

Someone said they called HO and it was said it’s only for the time the guidance is in place.
Which makes sense I’ve seen a lot of people now being approved and CSI wasn’t a topic.

However if that’s the case the guidance came out 14th of May which would mean it’s a requirement from that day on?
But two things confusing me.
The documents requirement at the form changed from 1st May on in mentions “if you spent some of that time in the UK as a student or as a self- sufficient person, and had comprehensive sickness insurance (CSI), a copy of your sickness insurance policy.”

I have seen someone being asked last month for more evidence (as only sent in Council Tax bills and they said it wasn’t enough) to get a list of documents they would accept and exactly that wording from above was included back then already.

My question is from what point this requirement is valid?

It would make sense from the time the guidance was published. Also the guidance refers to a question about CSI in the form and a box to explain why you didn’t have it. I haven’t seen that yet.

And the guidance also refers to applicants MUST provide CSI while in the wording above it says “...and you had CSI, a copy of your sickness insurance policy” which sounds different.

Were you a student during your qualifying years ? When did you arrive to the UK ?

Based on what the Home Office have said it seems they're arguing that CSI has always been a requirement for citizenship, and that they're just clarifying this requirement. Following from that logic, there would be no first date from which the new requirements apply - because they have "always" applied.

It's possible the caseworkers are exercising a larger degree of discretion for applications that were handed in before the new sections on EUSS and CSI were added to the guidance. If that's the case, I do hope the Home Office will be willing to look past the CSI requirement also for future citizenship applications.

Were you a student during your qualifying years ? When did you arrive to the UK ?

2012.
No I haven’t been a student. I have been financially supported for awhile which has reason I will at least try to explain to my caseworker. But before and afterwards
I have been in full time employment.

I’m in the situation where I applied two weeks before the new guidance, but my documents requirement changed exactly that day mentioning CSI.
I can see from my download the day before the wording was still the old one.
I completed my application in January, but had to wait to submit the application on the day I had Settled Status for full 12 months, which is their requirement.
I think I have been extremely unlucky with the timing.

In that case can anyone advice me if I already should explain in my cover letter why I didn’t have CSI or rather wait until they would require the documents?
