Citizenship Application Queries

Post by King0019 » Sat May 30, 2020 1:05 am

Hello everyone,
I’m just asking for a friend who came to UK on tier 5 visa . Expiry date of the visa 17/03/2014. She claimed asylum on 7 /03/2014 ( before her visa expires) and successfully granted
Time line for applications:
16-May-2013 G Curtailment Consideration - T5 TW -
Charity Migrant.
07-Mar-2014 AI Asylum Claim - Granted Asylum and LTE/LTR Served with IS151A
19-Mar-2014 GI Admin Removal: Overstayer
07 Jan-2015 G Travel Document
14-Nov-2019 Application
Settlement Protection - ILR Grant Refugee - I.L.R.

Would she consider an overstayer ?
Can she apply for British citizenship with no issues ?

Please if you have experience, let me know how best to advice her !.
Thanks in advance

To be honest , I don’t know the answer to your Question “What date was her visa curtailed to? “
But I know her visa was expired on 17/03/2014 and she applied on 7th March 2014.

The file shows she should be fine as far as I see

So why they considered her as overstayer then ? Would you have any input please ?
Thanks

You said she had a valid visa when she applied for asylum. An asylum application extends leave under section 3C meaning she could not be made an overstayer. What was in her IS151A letter served to her ?

I have been trying to upload the copy of the letter but it won’t let me this time .
But letter states the reason why ,

“You had leave to remain until 17th March 2014 however you have stayed beyond this time . This is an offence under section 24 (1)(b)(i)of the immigration act 1971 as amended”
19th March 2014

I will try again to upload a copy if I can .
Thanks
