EEA family permit for brother in law from Pakistan (EFM of a non EU spouse)

Post by Adeel_ali » Mon Jun 01, 2020 11:51 pm

Hi everyone,
My wife holds european passport can she sponsor my brother who is in pakistan,
Guidance for extended family members says

“From 1 February 2017 the rights of extended family members only applies to relatives of the EEA national and not to relatives of the EEA national’s spouse or civil partner. This means that an extended family member can no longer rely on their relationship to the EEA national’s spouse or civil partner in order to meet the requirements of regulation 8. Instead, they must show that they are related to the EEA national.”

However recently there has been update on guidance for direct family members that relatives of eu national and their spouses quality for family permit,

I would kindly ask experts for their suggestions on this or if any one has been issued a visa in same category,
Many thanks

EEA EFM is a bit of a hit and miss.

Some people just applied and got it with apparently weak applications while others have been repeatedly refused.

The EEA EFM rewards unemployment / dependency. So if your brother is an achieved professional or businessman, he certainly won't qualify.

Now if his main source of earning is demonstrably handouts from your wife, his chances are better but you won't know for sure until you try.
