Tier 5 to FLR M to ILR

Post by UKJPcouple » Fri Jun 19, 2020 6:44 pm

Hi

Could someone please provide some clarification about whether my partner can apply for ILR, having been in UK 4 years and 7 months.

I am a UK citizen.

My partner came to UK under Tier 2 Visa. We lived together from arrival. After 2 years we applied for Spouse visa and received 2.5 years after 1 month.
Total my partner would be here continuously for 4 years 7 months.

I understand this is around 5 months short of 5 year requirement. Can anyone advice on best option?

Thank you and apologies if this question is repeated. Every case is different and I couldn’t get a confident solution.

Best
P

This has nothing to do with how many years in total she has lived here. Your partner needs a total of 5 years under the family route via FLR(M) to be able to get ILR via SET(M). Time spent under PBS routes cannot be combined with the time spent under family routes to make up the 5 years required. She needs another FLR(M) extension to achieve this
