Hey Friends!

I am in a bit of a dilemma and need some advice. I’ve rescently sent in my application for naturalisation (ILR VIA 10 yr route), and am currently waiting for an appointment. My wife is American and I find myself facing redundancy in uk and with a potential Job offer in the US, meaning we may need to move sooner than we planned.

My concern is, if I start my application process for US Greencard (or work visa) before I get my UK citizenship, could that cause UK immigration to decline my application? As they may feel I won’t be staying here. I have a mortgage here and hope to return eventually. Any help/thoughts appreciated.

I can't find it but a lady asked whether to apply to the Home Office if she's eligible having lived here for over 10 yrs but she's mid process getting a visa to go live with her husband in France.

I think the response was that the case worker at HO can reject based on the fact they can see you already have 1 foot out of the door.

With the current climate, no application will be fast tracked anyway so why not just wait until 1's approved before getting a second application is state side.

Happy to be corrected if anyone else has a more definitive answer.

There are 3 separate view points: rules (law says this section is discretionary), interpretation and practicality.

Rules and instructions say you have to declare intent of living in the UK at that point in time and HO should believe you unless they have reasons not to. Given you've applied already, these are on your side.

Interpretation can go either way as there are multiple reports in this forum alone of big trouble applying for first passport after naturalisation from abroad.

And finally there is the practicality: how would they find out? There is no explicit question anywhere. You haven't lied as things changed after application. And the intention hasn't changed anyway. Almost same facts hold for first passport application, except the latter is much more visible.

I don't think anyone can tell you for sure. But in your specific case I expect more trouble from the US side while Trump is in office. Aren't work visas suspended? Even before that there was a quota. Greencard may be different... hopefully.
