Indefinite Leave to Remain as stateless

Post by amincey » Tue Jul 21, 2020 12:25 pm

Howdy,
I'm trying to find any information on the process of applying to stay in the UK under ILR as stateless. I know the laws changed in 2019 and under the system, you can apply for Indefinite Leave to Remain as a stateless person after 5 years.

On the UK.Gov site, there is nothing about the application process, where to apply, etc. I've spoken with Visa and Immigration on three separate occasions which were a complete waste of time. The last person I spoke with suggested contacting someone from the CAB which I have done and am waiting for a response after they have a look at my case.

Any help would be appreciated.

Requirements for indefinite leave to remain as a stateless person

407. The requirements for indefinite leave to remain as a stateless person are that the applicant:
(a) has made a valid application to the Secretary of State for indefinite leave to remain as a stateless person;
(b) was last granted limited leave to remain as a stateless person in accordance with paragraph 405;
(c) has spent a continuous period of five years in the United Kingdom with stateless leave granted under Rule 405, except that where paragraph 39E of these Rules applies, any current period of overstaying will be disregarded. Any previous period of overstaying between periods of leave will also be disregarded where: the further application was made before 24 November 2016 and within 28 days of the expiry of leave; or the further application was made on or after 24 November 2016 and paragraph 39E of these Rules applied;
(d) continues to meet the requirements of paragraph 403.

You can only apply for ILR as a stateless person after having spent five years in the UK on limited leave to remain as a stateless person.

Apply to stay in the UK as a stateless person.

Probably should have mentioned in my original post. I've already applied and been granted leave to remain as stateless twice. My current leave expires next year in September.
