Overstayers leaving before October

Post by raina » Sat Aug 23, 2008 3:15 am

Does anyone know if overstayers who are now currently leaving the UK before October on their own expenses are being caught at Heathrow and handed any stamp or paper?

Also if they get this stamp does it affect them from applying for another countrys visa for the rest of their lives?

For eg. Shengen visa or Australia?

A paper. No stamps in passports as far as I am aware. The "being caught" does not bear much sense here, there is nothing to catch you for - you are leaving.
To minimise "risk" being checked at departure, suggest you depart from smaller airports and transit through another EU country.
For eg. Shengen visa or Australia?
Doubt it about EU, definitely not Australia. Australia has no way of knowing or finding out about your immigration history in the UK unless there are records in your passport that you will be using for your visa or you give them information yourself. However, according to the Migration Act 1958 in Australia if you do not provide honest and full information on the application form you are risking of your application being refused on the character grounds. Foreign governments considering your application for admission on their territory do not have to be "convinced" that you give truthful information on your application form, any reason of them suspecting this not being a case will result in the refusal of your application.

If you are unlucky enough to find yourself getting caught on exit, they might / will serve some paperwork against you and that is about it. You might also find they write IS151 on the edge of the passport.

As for coming back in - it will have no bearing as long as you meet the immigration visa requirements and can prove you left the UK before 1st October.

As for other EU countries, unless you were convicted of some serious criminal offence in the UK they will not know about the overstaying element. More than likely they can work it out as the entry stamp back into your own country will be some time after the expired visa.

Thankyou for confirming this I think many people are still scared of the thought of getting a removal notice at the airport I am one of them but as long as you provide all the details that you paid for your own flights and you left the Uk before 01 Oct 2008 then you shoul be fine!good luck

stressed guy

Post by karina10 » Thu Sep 18, 2008 8:56 pm

hi
im in a great stress
my gf came here as a tourist and overstayed for nearly 2 years ,now she wants to go back to her country and apply for a student visa, what are her chances getting the visa?, will she be banned from returning if they get her passport checked at exit control?, is this " grace period " that you talk about also for people who overstayed their tourist visa and seek to come to study?
if they check her passport at exit control will she be baned for 5 years?
wouldnt it be better if she leaves voluntarilly after the 1 october , so if she gets a ban that would be for only one year???
im really worried and dont know what to do .
pd: how can they know that she overstayed if eventually there is no exit control at the airport?
and ANOTHER THING, they can say "grace period" but can they refuse if they want even if you povide all the documentation?, i guess they can...
how do they know if you overstayed???
pd/. any suggestions on which airport ?
please advice.
cheers stressed guy.

My boyfriend left from Gatwick in August to go back to Albania and immigration officers wrote "IS151A" in his passport. I've been to visit him in Albania once in August and once in September and the boarding gate to Tirana was surrounded by immigration officers checking passports and asking how much cash we were carrying. Sniffer dogs checked our bags. Very intimidating!

I think you'll find the officers at the gate were Customs detection staff.

i flew to pristina and drove to albania with £15000 in my hand luggage. i was so scared, but got through fine.

Adi got caught by immigration and sent home, he didn't get a stamp or anything written on his passport. Once he got to Tirana he was just free to go.
