EU Settlement Scheme for Mother

Hello Everyone,
I got married to an EU national, came into the UK in July 2019 via the EU family permit and got my biometric residence permits in December. My mother has been using the visitors visa for over 8years to be with my sister in the UK. My mother currently has a 10years visiting Visa and is in the UK with my sister who has a permanent residence in the UK. Due to COVID-19, my mother is yet to return back to Nigeria and my sister suggested my husband use the EU settlement scheme to request his mother in law remains with us even though her Visa status is not through my husband. My questions are
1. Is it advisable for my husband to apply for the EU settlement scheme for my mother despite the fact that all her approved Visa routes has been through my sister's permanent residence?
2. Does my mom stand a chance of getting a stay when my husband applies even though her Visa application has always been routed through my sister ?
3. Will her 10 years visit visa be jeopardized if my husband applies and she is denied?

I really would love my mom to stay but I'm just scared that since she has never used the EU route, she maybe denied on the grounds that she should continue with my sister's route

Hello,

Only an EEA national can sponsor someone under the EU Settlement Scheme. Any UK resident can help with a visitor visa but for the Settlement Scheme only an EEA national can be the sponsor. So your sister with her ILR cannot help with that.

If the EU Settlement Scheme works, she will have a 5-year residence permit and, if everything stays the same, she will get a permanent residence in 2025.

If the endeavour fails, she will never get a visitor visa for as long as she shall live.

There are plenty of testimonies on this forum if you search. Many managed to bring their relatives using this route. It's probably one of the easiest ever but there is always a potential risk of refusal.

Since my mum is currently in UK visiting with her visitors visa can she apply here in UK due to covid 19 or does she have to go back to Nigeria to apply? Many thanks.

I think her visa expires after Sep 1st. Actually, if the visa expires before September 1st, she can apply from within the UK. But if her visa expires after Sep 1st, she can still apply from within the UK.

That's hard! You won't be able to sell them the idea that she must apply now as there is a job waiting for her or a university term she is going to miss.

Now, a word of caution: I am NOT encouraging you to apply. I am merely showing you the resources that are available online. The EU Settlement Scheme may or may not work for you guys. If it doesn't work for your mother (she is eventually refused), she will never be able to visit the UK as they won't give her a visitor visa (even in 10 or 15 years!).
