ILR BRP Expired

Hi All,

2 days ago i realised that my daughter's ILR BRP got expired in March 2020. I have booked an appointment for the renewal this month but it seems that the process is 6 months long for a new one to arrive in hand. I have to travel back to India for some urgent work and i am stuck in a situation here about the immigration.

Question is will my family be able to travel to India and back even if the BRP has expired for my daughter. Some post say it us ok some say its not.

Does anyone know what can be done in order to travel to India without any issue.

You cannot board a plane to the UK without a valid BRP/visa as an airline will refuse to board her. It is your responsibility to ensure BRP card is always valid. One solution is to apply for a ‘replacement BRP visa’ from outside the UK, which lets her re-enter the UK once only. It costs £154. She then can come to the UK and apply for a new BRP then.

Yes i do 100% agree with your statement about our responsibility on BRP validity. It my badluck which ended me in this situation.

Having all said i did check the link and it is useful but got couple of doubts about it. can you please shed some light on below quires please:

- I have applied for the new BRP card recently via normal procedure in UK and as per norms it might take around 6 months for new card to arrive at my UK address. I am planning to travel to India in next 3 weeks assuming no one will stop my daughter as she has her Indian Passport and visa checks are not done when departing and entering India on indian passport. Have i done the correct thing i applying for new BRP before leaving UK ?

- During the replacement BRP process from India, do i have to declare that i lost the BRP card in India ?
- And do i have to mention that new BRP card application has already been made in UK during the replacemet application.
- Will my application for replacement be considered being said the BRP has already expired in April 2020 ?

Apply from India for a replacement BRP visa. This should not interfere with the BRP application in the UK. That will take 6 months or more.

As per previous question do i have to report that my BRP is lost ? And will they issues a single entry on expired BRP please ?

It is expired, NOT lost. While the ILR status does not expire the card does. The visa will be a single entry, then it is expected the person to enter the UK and then apply for a BRP (you already did that)
