Extended family of eea national through Eu route

Post by Skp123 » Mon Aug 17, 2020 11:24 am

Dear Sir/Madam,

I am family member of Eu national , I have PR Card and also I have got settled status.

My wife who is Eu national , also has PR and settled status .

We both live together since 2013.

She is employed full time since 2005, and I am employed full time since Late 2013.

My brother lives in Pakistan and he depends on me and he is married aged about nearly 50 years old.

I have question here that can my wife or I can apply for my brother as an extended family route ?

As I have settled status as well and although I have applied for my british nationality and it’s in process so can I apply directly for him or my wife who is Eu national and have settled status can she apply for my brother on Eu route ?

What I need to prove as evidences ? Bank statements , money transfer ?

Or what are the sufficient evidences I need to provide as December 2020 I might not apply after that ?

I need a good advice with details from senior moderator please ?

Kind Regards

Hello

If you just posted this a year ago, I would've responded with something around the lines, "it's not possible".

In the recent months, I have seen crazy applications getting successful under the EU Settlement Scheme. I am not claiming that any application works but immigration to the UK haven't been any easier in the last 10 years. Applicants that would have had zero chance just 2 - 3 years ago are getting 5-year pre-settlement status.

Your wife must sponsor your brother. The sponsor is always the EU citizenship holder. There is no exception to that.

However, for the dependency, the EU Settlement Scheme is now talking about dependent of an EU National or dependent on the spouse of the EU national. I am quoting from memory a guidance I read but you may need to download the guidance and double check that point as it is crucial for your case.

You also need to consider the financial commitment of having an adult on your charge in the UK. It's not the same as assisting the same adult abroad. Most people usually don't have enough disposable income to afford that. But this is not tested by the Home Office. It's just for you to know that there is a big burden on your finances should this application work.
