Can I switch WP to Tier 1 from overseas?

Can I switch WP to Tier 1 from overseas?

I am a work permit holder and wish to switch my WP to Tier 1 (gerneral). Can I apply it from India when I go back for holidays? Will I still satisfy the ILR 5 years continuous requirement?

You can apply from India whenever you wish to.

Regarding ILR, as long as your WP is valid when you apply for Tier 1 and that you return to UK within 90 days, you should be fine (i.e.- you don't lose on the 2.5 yrs. on WP).

Hello Sushdmehta,

I wanted to check if I can switch to Tier 1 from my employer sponsored work permit in UK itself. Its been just two months I have arrived in UK and my existing work permit is valid till Oct 2009.

If I can switch to Tier 1 from UK then can I show my Indian Salary for last 9 months + UK allowances for last three months to claim points for salary? For maintenance funds, will I be required to show funds (GBP 2800 + 1600 for dependent) in India Bank account for last three months or (GBP 800 +600for dependent) in UK Bank account? To clarify, I have maintained both the balances till now.
How does my case fare if my wife is in UK as dependent work permit holder?

Please advice.

3. 800 (self) + 1600 (each dependent). Which Bank? - is immaterial.
4. WP dependent can switch to Tier 1 dependent in-country.

You must read the Tier 1 policy guidance and Tier 1 (dependent) policy guidance *carefully*, because answers to your questions are clearly explained in there. Both documents are available on UKBA website.
