Dillema

Hi! I hope here there's someone who can help better that my university adviser. My student visa has an error and expires in 2 months. The university adviser applied for correction 3 months ago and so far we had no answer. Although I know that he is allowed to enquire next week but god knows how much time it will take HO to reply. Anyway, I can either wait for their response until my visa expires or can try to switch my visa to dependent visa as my husband has a student visa until January 2010 (BTW is it possible or i'm daydreaming?). Any help? Many many many thanks

The nature of the error is not clear - are we to infer that the period granted is shorter than expected? (so is that an error or a considered decision by the ECO/caseworker to grant a shorter period than requested); or is there some other anomaly on the endorsement, but the visa would be expiring in 2 months anyway?
If this is a visa issued abroad, and your university advisor referred it to UKBA, they will have had to refer back to the issuing office, who may not have perceived any urgency.
It is a risky strategy to allow the visa to expire. Any subsequent application is liable to be refused without right of appeal, for being out of time. If your current problem has not been resolved by 4 weeks before your visa expires, make another application. If it's easier to do so as your husband's dependant, then you have a choice. The upside of applying as his dependant is that you would not be restricted as to your hours of employment. The downside is that if he got thrown off his course because he couldn't pay or he couldn't do the work, his stay could be curtailed and you'd be out as well.
