Travel abroad before applying for the new visa

Post by ukg » Thu Apr 14, 2005 3:57 pm

Hi,
i have been working in UK since 3 yrs. 2 weeks back i got my Work permit transfered and joined a new company , in UK. My earlier visa's expiry date was december 2005. It is mentioned in the new work permit that i should apply for the new visa (submit the FLR form) within the next 6 months or before the end of the current visa, which ever is earlier.
Now i have to travel abroad and since i need the passport i have not yet applied for the new visa. Is it alright that i travel abroad with the present visa and then apply for the new one after my return (in 2 weeks time).
Will i be questioned at the Heathrow airport and will there be any problem?

i would appreciate if you can answer my query and let me know what should i tell at the airport.

thanks

I think that shouldn't be a problem provided you enter within validity of your documents (passport+leave to enter/remain)...

There is no such thing as transfer of WP. What you have got now is a new WP. Strictly speaking your WP and visa are valid as long as you have employment with the company which applied for it.

You might get in through this time on your present visa but there could be problems when you apply for your ILR in future as they look at all your work permits, visa and entry stamps quite closely. I would suggest that you delay your trip until you get your new visa.

problem during ILR ???

Post by ukg » Thu Apr 21, 2005 9:34 am

even if i travel abroad now and come back , when i apply for my ILR in future i understand they will look at my work permits, visa and entry stamps quite closely. But where is it illegal or wrong. Its clearly mentioned on the new WP (and also the agency which applied for me mentioned the same) that i need to apply for the visa before the end of the present visa or within 6 months which ever is earlier? so if i travel and come back in a month and then apply, it still will show on the passport that i applied within 6 months as stated on the work permit. SO where is the problem here.
Is there anyone who has personally faced a problem , in this situation, during ILR application?
