Family given status, What should I DO? Help Please.

Post by angelangelangel » Sat Sep 06, 2008 2:48 pm

Hello,

I claimed asylum in this country along with my family (i.e. mother and brother sisters).

My lawyer lodged a fresh application on my name when I turned 18. It has been 2 years and My application still remains pending with the homeoffice.

Now my family is being issued status papers but my name is not mentioned on them because i have a separate application under my name.

What should I do now? Should I contact the Case resolute office asking them to deal with my case since the rest of my family is being given status? Or what?
My M.P. is willing to put any application on my behalf. What should I ask him to write?

ANy replied will be appreciated.
Thanks

if your family is getting status i am sure you can ask your case to be expedited based on a case out of line with linked cases. have a look at the document below and good luck

Thanks for your response.

Actually, My family's initial asylum case was refused. After that I turned 18 and a case was filed on my name. The home office refused my application but a week later withdrew its refusal leavin my application still pending with them.

6 months back our lawyer filed a sperate case for my family ( excluding me because my case was as it is pending with the HO.
Now my family is being granted status.

Surely, I can get in touch with the Case resolution centre and ask them to grant me status as well right? Because, I will then start having Housing issues ( as I live in NASS house ) and other things.

Any more views pleasE??

I also agree with 4444. Why did your lawyer file a separate asylum claim when u turned 18 though? Surely he should have left it to the HO to decide if they were going to separate u from being a dependant of your family? There're people here & on the other board who got status as dependants with their families aged 19 & even 20 like u. Even I have people like that but they weren't assessed separately. Seems odd to me to make the decision to separate your claim if HO hadn't yet classified u as being independent of your family.

Hello,

Once someone turns 18, They can file a separate case if they want to. And the reason why my lawyer did that was because Our case as a family was refused.. And to be on the safe side he did that.
Anyways, he didnt ask me while doing that But I think what he did at that time was right because last year my family was detained.. But I was left behind because My case was still pending.....
And because I was behind.... I chased my family's case.. Involved the M.P and stopped the HO from deporting them.. There flights were cancelled and they were moved to the detention centre.... They were later on released because My lawyer applied for a judicial review .. But more then that my family was sent back hope because I was alone at home.

All this is history now.. I CANT UNDO what my previous lawyer did ( we hv a different lawyer now)...

All i want to know is what is best for me to do based on my CURRENT SITUATION?

Thanks
