ILR Doubts related to Work permit transfer

Post by samW » Sun Sep 07, 2008 10:39 am

Hello all,

I'm planning to apply for ILR on 19th Sept. 2008 and I have some doubts.

Just listing below my situation

- Entered UK on Work permit (with Company A) on 12 Oct 2003. This work permit was valid for 1 year (till Oct 2004)

- Changed job in Sept. 2004 . New company (Company B) applied for a new work permit which was valid for 5 years.

The P45 form of Company A shows a leaving date of 10 Sept. 2004

New Work permit (Company B) shows a start date of 15 Sept. 2004

I was within UK while the Work permit transfer took place

- Changed visa to HSMP on 22nd Jun 2007 (valid for 2 years)

Doubt 1- Will the "gap" between 10 Sept. 2004 and 15 Sept. 2004 cause an issue in the ILR application ?

Doubt 2 - Is this is a straightforward case? Please advise if you see any issues with this ILR application

Please provide your valuable input on this.

Awaiting your quick responses,

Thanks,
Sam

I seriously doubt that there would be a problem with a gap of a copule of days between jobs. however did you wait for permission before you joined company B?

Hello PaperPusher,

Thanks for your reply.

I joined Company B only after they confirmed to me that the work permit was processed.

New Work permit had a date of Sept. 15th, 2004. I joined on Sept. 16th, 2004.

Please let me know if this would be ok

Thanks,
Sam

Whats relevant is not the date of the Work Permit approval date but the date on the FLR(IED) or your passport stamp.

samW, did you get new leave when you moved to company B, a new ink stamp?

If so, you will be fine.

Hello PaperPusher,

There was no stamping done on the new work permit since this was an in-country work permit transfer

Will this cause an issue? Please let me know

Thanks,
Sony

You need to get your passport stamped regardless of the fact if its in or out-country.

Sorry I think theres some misunderstanding here.

When you got your Work Permit did you also get your passport stamped with the new Residence Permit?

Thats the "stamping" in question.

SamW, Everytime you switch from WP to another WP you need to send your passport to Home Office for a new residency stamp, even if you have a valid RP in the passport. Did you do this? :!:

Yes, the new residence permit related to Company B was stamped.

1) My concern was gap of 4 days (i.e between the P45 form of Company A shows a leaving date of 10 Sept. 2004 and the new residence permit (Company B) implying a date of 15 Sept. 2004)

I just wanted to check if this gap would cause an issue.

2) I also noticed yesterday that an entry stamp (related to short a company related trip out of UK in 2004) is missing in my passport.

Will this cause an issue?

This whole build-up to the PEO appointment is giving me lots of sleepless nights !!

Please advise

Thankyou all for your input so far
