Hello all,

I've been a student for 8 years, then I went onto SEGS for 1 year. After the 1 year of SEGS, I was granted a 1 year student visa from the home office for my MSc. This covers a period of 10 years.

1998-2006 School and Undergrad (student)
2006-2007 Segs
2007-2008 Postgrad (student)

My question is, am I eligible for the ILR even though I swapped statuses, although from within the UK?

Also, what are the terms for absences for an application for long term residence?

You may be eligible to apply for SET(O) under Long Residence. Don't forget the KOL requirements.

I have the same stats, I applied for the ILR was refused, however this was due to days laps in my Visa application back in 2002 and 2005. You should not really have a problem applying for the ILR if you do not have any laps in your previous Visa application.

If you want to know if you have a problem or not, go to HO itself and if they let you proceed to the payment section after they check your documents then you will get your ILR the same day. If not ask for reason they are not proceeding and they will tell you.

Also if you want to know if you have any lapses, just look at all your Visa you have got and make a chronology of each one.

Hello all,

I got my ILR! I thought to post in case someone else has questions.

My case was successful because I was a resident for 10 years continuously-I always got my clearance from the home-office. Also, I passed my life in the UK test.

NB. I took my case to a lawyer so that it was less likely to be rejected. They told me that in order to have a stronger case, it was good that I was not idle whilst on SEGS (I was working).

So, lessons learned: Try to get your clearance to remain in the UK from the home office-this makes it continuous residence. And, if you have entry clearance, eg post-study work, use it to work!
