Tier 2 -Leaving the UK before the decision comes out - Please Help

Post by qk830 » Mon Oct 26, 2020 12:57 pm

Hi! I would like to know if I leave the UK before the Tier 2 application result comes out, would it leave a bad record and impact my future visa applications negatively? I made this decision as I don't intend to work in the UK anymore. Please note that my student visa has expired on 31th of July with the visa extension granted by Home Office, so technically I don't have a valid visa for my stay in the UK.

I ask this question because my employer has made a very stupid mistake that puts me in a desperate decision, and I am thinking about quitting the job to reunite with my family and escape from COVID here. In fact, my employer applied for the CoS 6 months after I started working, so I was working on my student visa for 6 months. I think that's not very legal, but I didn't know about it back then.

After I attended an appointment, I received an update on 19/10 from Home Office Atlas by email which states that my employer made a mistake about the length of my employment on my Certificate of Sponsorship. My sponsorship should be 3 years under the Tier 2 New Entrant category, but my employer entered 4 years on my CoS. (In fact I was curious why this CoS got approved in the first place, because 4-year sponsorship isn't even an option for a Tier 2 visa. My coworker got the same mistake as mine on her CoS, but her BRP is already issued.)

I was asked to respond within 7 days, but otherwise my application may be rejected. However, when I tried to reply to the email from Home Office Atlas, I found the address seems to be unmonitored. So technically, I was asked to make a quick response but wasn't informed of a way to do it. The whole thing is strange,

I have called the UKVI general helpline multiple times, and also posted letters to the UKVI office in Sheffield. The adviser has escalated my case over the phone, and I was told to wait for a response that might come within 10 working days. This all seems too long…I was expecting the visa to be issued a few days after my appointment and had made my travel plans for November, but this just messed up everything. And I have lost patience with my company because of their stupid mistakes throughout the year.

If you can give any advice regarding my situation, I would be really appreciative. I am just really hopeless now!

Thank you!

Hello

Employers make a lot of mistakes with Tier 2. Sometimes genuine, sometimes not but at the end of the day, it affects your status.

I understand you willing to go abroad for a while to escape Covid in the UK. This country is turning into a police State that would make a lot of places like heaven on earth.

Read the email carefully. When you respond, don't change the subject.

To minimise the impact on your future applications, play fast and good faith. Buy a ticket and send them a copy. Tell them your circumstances and that you realised the mistake made by your employer and therefore you chose to quit the UK asap. This will limit the impact of what happened on your immigration history.
