I have a bit of scenario I came to UK on my Tier 1 entrepreneur in November 2015.
Applied for ILR (accelerated route) on 13 March 2019 But unfortunately my application was rejected due to jobs creation in Aug 2019. I have applied for AR it got rejected within a week after applying. Then I applied for my Tier 1 extension application in Sept 2019 and it got approved in October 2019 (all the application was in time) granted visa till October 2021. I have completed my 5 years in Nov 2020 but i have visa till Oct 2021.
Please note I had 4 full time employees 36.5 hour per week from March 2019 till October 2019 (The time I first applied my ILR accelerated route until I got my extension feedback).
The employment continued for 3 employees till March 2020 one of them went for maternity leave in October 2019.
From March2020-Sept2020 all 4 employees were furloughed. I know this time won’t be counted toward the application.
Now from 3rd Oct 2020 all 4 employees are again on my payroll and I have reduced their hours to 30hrs per week as per the job’s requirement and updated their contracts also.
Now my question is that jobs are counted from last leave to remain. Which is OCT 2019 . Or I can take into account of jobs that were created before that. (March 2019-oct2019)
Also, can I merge 2 full time employees working consecutively to make the month as now job requirement is flexible? For example
1. Job 1 Full time (30hrs/week for 3 month) job 2 full time (30hrs hrs/week for 3 months) at the same time can I count it as 6 months?
Please help me with this as I still have time to get the jobs fixed before I apply ILR.
