Naturalisation with Separation

Here’s my situation:

1. I am a non-EU citizen and married a non-EU citizen few years back
2. My wife has never visited UK on any visa
3. We have been staying separately since last 2 years (we are not separated legally)
4. There has been no court or divorce proceedings so far.
5. Last year, in my ILR application, I had put separated as my status (since the application did not mention anything about legally separation)
6. I have completed 5 years on Tier 2 general, then got my ILR, then completed 1 year on my ILR and am now due for my citizenship application submission.

I want to know what should I put in my application:
1. Married or Separated?
2. While I am separated, I don’t have any legal documents to show that. What kind of documents are requested as part of the process ?

Separated. Your marriage status is irrelevant in your case i.e. Section 6(1) of the BNA 1981. No documents needed for marriage/separation.

Could you please help me with this query which is related to your reply.

The application also asks to provide previous partner details. The questions are:

1. Have you been previously been married or in a civil partnership. -> I HAVE TICKED YES. (IS IT OK?)
2. Name, date and place of marriage etc -> I HAVE PROVIDED THESE.
3. Date your previous marriage or civil partnership ended -> Since I do not have any document that shows any particular date of separation, I am thinking of putting the most appropriate date when this was kind of agreed, any advice from you on how I should think about this?
4. Reason your previous marriage or civil partnership ended (For example, death or divorce) -> The reason for separation was Incompatibility. Is this reason OK to put here? If not, What should I put here?

You are separated. You do not have an official divorce as yet so you are still not un-married. Previous marriages will be NO (if you are talking about this marriage and not any other).

Can you please help me with 2 more queries:

Q1) Have you made any previous UK immigration applications in the UK or abroad? I have answered YES and added 3 sections to it - One for my ILR and Two for my Tier 2 general visas that I had before ILR. Please confirm if this is ok?

Q2) My 2nd query is regarding a question that is a part of each of these section - "Enter your reference number if known". I have entered UAN number for ILR section. But for my tier 2 general visa, I also have a case ID number apart from the UAN Number. I checked my ILR form (that I submitted last year!) and I had mentioned my Case ID number as my previous immigration reference number. So, My query is that for my Tier 2 details, should I enter Tier 2 UAN number or Case ID number for this question?

Yes. You need to list all UK immigration applications

Anything is ok, UAN, CaseID, BRP number and this is an “if known” question. You can even leave it empty if not known

Proof of living in the UK -> as per the following:

If you do not have your passport or it was not stamped when you entered the UK, you need to include letters (for example, from your employer or government department) as proof.

I am uploading my passport first page and last page but am not uploading all the pages with stamps (as they are too many). Instead I am giving the employer letter and P60s.

You are a non-EEA, you must rely on your stamps. You should upload all of them for the qualifying period. You do NOT need employer letter in this case.
