Questions on defacto partnership.

Post by Sillybilly88 » Wed Nov 11, 2020 1:26 pm

I am currently preparing the docs to apply for a defacto partnership for my partner(will apply after covid calms down). I am an Irish national residing in a non-EU country, she is from the same country. We have been together 6 years and living together for about 3 now(will be 4 when we apply).

I have been working in this non-EU country now for the 6 years. We have plenty of proof together including flight bookings, hotel bookings, photos and our shared apartment lease, previous visas from her trips to Ireland etc... Most of the info on the immigration page regarding defacto is based on the sponsor(myself) living in Ireland. She needs to get "preclearance" from Dublin, I emailed them yesterday and they said there is no issue with me residing outside of Ireland it won't impact her application. They also told me the preclearance will take about 12 weeks, and after that a few weeks for the visa.

As I am working here all my financial documents are based here, my employment contract bank history and so on... As this preclearance needs to be applied for so far in advance, I definitely wouldn't have began to even look for a job in Dublin as I wouldn't be able to start for 4+ months. But I will be working when I get back to Ireland and have decent education/work experience history. Can somebody advise on this? We have decent savings between the both of us. Is the fact that I don't have an employment contract in Ireland going to cause any issues? Would having our savings help with this at all? We would easily have 30k between both of us.

Cheers!

As long as you meet the financial requirement you're ok. I moved to Ireland as a de-facto partner of an Irish citizen who spent many years living in Russia. He had to proof to the Embassy that he earned 40000 euro (equivalent in Russian Rubles in our case) in the last three years of his residence in Russia.
I don't know if this requirement still the same. But answering your question it's not going to cause any issues. Foreign employment and financial documents will be fine.

Thanks Vorona, I will definitely be good on that front! It is indeed 40,000 over a 3 year period still. Can you verify that he didn't have any job lined up in Ireland? Do they expect the sponsor to have a employment contract in Ireland for a job starting in the future?

You're don't need to have a job secured on arrival, but you are expected to support yourselves financially after moving to Ireland. It's one of the criteria for de-facto permission. Having savings for a few months will be very helpful. Your partner will get a Stamp 4 permission that will allow him or her to work.
