ILR ELIGIBILITY OF MY DAUGHTER BASED ON FATHER'S ILR

Hi this is Suchitra,

My daughter currently on Tier2 PBS dependent visa from 18 April 2018 to 12 February 2021. My husband got his ILR valid from 23/03/2020 to 31-12-2024 (Through 5 year Tier2 general shortage of occupation category route).

My daughter would be finishing 3 years by 12 February 2021, and she born in India.

I would like to understand if she is eligible to file ILR based on my Husband's ILR status in UK?

Could someone help me with this please?

What is your own immigration status? Assuming you are on PBS dependent visa also, your daughter born in India will be able to apply ILR when you apply your own ILR.

Thanks a lot for your response.

I am on Tier2 PBS dependent visa as well. I am not yet eligible for my ILR as such wanted to apply for my daughters ILR based on my Husband's ILR.

Is my child eligible for ILR based on my husband's ILR, considering her stay in UK is less than 5 years?

could you please help?

No. She can only apply when you apply for your own ILR.

oh that means each applicant has to complete 5 years of stay in the UK, before filing for ILR application?

No matter whether the applicant is adult or minor?

No matter whether the applicant is adult or minor?
No. But children born abroad can only apply for ILR with the less privileged parent (in immigration sense). Residence does not apply to them if they are younger than 12 years old.

No. She will apply when you apply for your own ILR as she is born abroad.

Hello CULLINAN,

Wanted to quick ask the below question regarding filing Mine and my daughter Tier2 PBS dependent extension based on my husband's ILR. Wanted to understand the funding requirements.

Currently We have a funding issue to file our Tier2 PBS dependent visa extensions £2,205 (£945 for main applicant plus £630 for myself and £630 for my daughter) for couple of days, as such wanted to understand the below.

1. Does my husband need to show £945 for his maintenance also along with our maintenance fund of £630 each, in total £2,205 for a period of 90 days as he is currently on ILR?
1. Can we show funds from abroad account?
2. Does it need to be joint account?
3. If we don't have joint account, can I show my bank account statements(Suchitra Kambhampati) along with my husband's UK bank account while filing the application?

Could you please help me with information, as it is really essential and urgent.
